Overview of Family Law in Hong Kong 香港家事法概覽

Family law in Hong Kong encompasses a wide range of legal issues related to marriage, pre and post-marriage agreements, divorce, welfare of children, asset division, maintenance and domestic violence. These areas require sensitive and professional legal navigation due to their personal and emotional nature.

香港家事法涵蓋了與婚姻、婚前和婚後協議、離婚、兒童福利、資產劃分、贍養和家庭暴力有關的廣泛法律問題。由於這些領域本質上牽涉私人及個人情感因素，因此需要敏銳及專業的法律指導。

The practice of family law is governed by common law and various ordinances. The key legislations relating to matrimonial and family proceedings include the Marriage Ordinance, the Matrimonial Causes Ordinance, the Matrimonial Proceedings and Property Ordinance, the Family Procedure Ordinance, and the Guardianship of Minors Ordinance.  The Ordinance governing domestic violence is the Domestic and Cohabitation Relationships Violence Ordinance. 

家事法受普通法和各種條例所規定。與婚姻和家事訴訟有關的主要法例包括《婚姻條例》、《婚姻訴訟條例》、《婚姻法律程序與財產條例》、《家事訴訟程序條例》和《未成年人監護條例》。而家庭暴力事宜則由《家庭及同居關係暴力條例》管制。

The Family Court hears applications pertaining to divorce and separation as well as other related family and/or matrimonial matters. Notwithstanding the limited general civil jurisdiction of the District Court, there is no monetary limit in the Family Court. Applications under the Domestic and Cohabitation Relationships Violence Ordinance and the Inheritance (Provision for Family and Dependants) Ordinance are also dealt with in the Family Court. Most hearings in the Family Court are conducted in private, save for defended divorces and enforcement actions. 

家事法庭負責聆訊有關離婚和分居的申請以及其他相關的家事和/或婚姻訴訟事宜。有別於區域法院一般民事案年的司法管轄權，家事法庭並無申索的上限。就《家庭和同居關係暴力條例》和《遺產（為家庭和受贍養人提供）條例》所提出的申請也在家事法庭中處理。除了有抗辯的離婚案件及申請強制執行判決的訴訟外，家事法庭大部分聆訊均以非公開形式進行。
